Vacation <br />Applicants seek to vacate 33* of Navarre Lane that abuts the property along the north <br />or west lot line. Staff and Planning Commission conceptually approved the vacation <br />but have recommended that the vacation be extended to the northeast to the intersection <br />of Olive Avenue, refer to Exhibit BB. In exchange for vacating the public nght-ot-way. <br />the Citv will ask for additional stormwater retention area in the future retention pond <br />to be installed on the church property. This section of road has been barricaded and <br />closed off from public use since the early 1960’s. Sewer, water, telephone and gas lines <br />exist within the right-of-way. The City will retain a drainage and utility easement over <br />the entire 66’ of right-of-way to be vacated. <br />The Citv Attorney has advised that the original vacation would not cover the more <br />con,prchensivc vacation proposed by City, nte City will hold a public hearing at the <br />Anril meeting of the Planning Commission to cover the vacation ot the roadway from <br />ihrw"ersection of the- County road to the intersection of Olive Avenue and <br />Navarre Lane. <br />The church has provided a written statement reaffirming that they would approve a <br />holdinu pond being created on the church property to support ot the <br />comme-rcial development of applicant's B-1 roned property, relcr to Exhibit W.
