Request for Council Action continued <br />Page 2 of 3 <br />February 23, 1996 <br />Zoning Code Amendment _________ <br />Setback. The Planning Commission recommendation provides for 50' setback with <br />a greater setback potentially required at the discretion of the City Council. It is staffs <br />recommendation that the setback should be set at the ma.ximum distance that may be <br />required and allow for a variance to that setback based on the impacts ot the use such <br />as noise, lights and intensity of activity. <br />The current ordinance provides for a 50’ setback for schools; however, the ordinance <br />also provides for a 100' setback for clubs, camps, etc. (see 10.20 Subd. 30. Staff <br />recommends establishing a 100’ setback, leaving Council the ability to grant a <br />variance to the setback distance if they so choose, based on factors such as those <br />noted above. <br />The Planning Commission recommendation includes Council approval of a land <br />lease arrangement between the school and a non-profit organizartion operating the <br />icc arena. Staff recommends the City have the ability to review and comment on a <br />land lea.se arrangement but would stop shon of requiring City approval of the lea.se. <br />Safety/Proximity Issues <br />The relationship between the high school use and the indoor ice arena use involves an expectation <br />of student and public pedestrian traffic between the two facilities on occasion. From a safety <br />standpoint, similar to what the B-2 code requires for marinas, an additional requirement could be <br />added that the indoor ice arena and high school uses shall not be separated by a public roadway, nor <br />shall the parking serving the arena be located across a public road from the arena. This will also <br />have an impact of limiting the potential sites for an arena use. <br />Staff Recommendation <br />Amendment language rellecting the staff recommendation is included in Exhibit A. The staff <br />version has been placed in Ordinance format for adoption if Council so chooses (Exhibit B). The <br />Planning Commission's recommended version is included as Exhibit C. The staff version contains <br />the condition prohibiting separation of the arena and high school uses by a public road as discussed <br />above. Staff recommends adoption of the staff ordinance version.
