Subd. 3(A): 'Schools’ Conditional <br />Use Permit - Add 'Indoor Ice Arenas' <br />List of Exhibits <br />.A - Proposed Amendment (Staff Recommendation) <br />B - Staff Version of Amendment in Ordinance Format tor Adoption <br />C - Proposed Amendment (Planning Commission Recommendation) <br />O - Current Code Section 10.20 Subd. 3 <br />Purpose of Code .Amendment <br />The City has detenmned that the indoor ice arena use docs not fit into the current list of conditional <br />uses in the R-1 A zone (to which all other districts refer); however, it does make sense that this use <br />be allowed as part of a school campus since a substantial pan ot its use. and the most intense use <br />(hieh school hockey games) relates to the school. Because of the intensity ot the use. stalf wanted <br />to place sufficient controls on the use to ensure against adverse impacts on neighboring residential <br />properties. <br />The method staff chose to accomplish this was to add the ice arena use as an accessop' use to a high <br />school (the high school being the principal use). The standard zoning concept ot an accessory' use <br />relies on that use being accessory to a principal use on the same property. The purpose ot making <br />the ice arena use an accessory use to a high school is so that the ice arena is located somewhat <br />contiguous to the high school which is akeady having .some level of impact on the adjacent <br />residential uses. This language is intended to avoid this type of intense use being placed on a parcel <br />the school owns but that is disconnected from the principal school uses. <br />The Planning Commission recommendation on a vote of 3-1 included several changes to the staff <br />recommendation. A discussion of each of the.se is as follows: <br />I..Accessory- use. The Planning Commission recommended that the ice arena be located <br />on property owned by the .school but not necessarily on the same parcel as the high <br />school. This eliminates the required connection with the principal use which is <br />important to controlling the impact on adjacent residential u.ses. <br />•s
