Zoning File #2201 <br />January 7, 1997 <br />Page 2 <br />Original Plat Dedication <br />The original plat of Pleasant View Lake Minnetonka dedicated these streets and the park area <br />to the public forever. The intent of dedication of right-of-way is to provide for pedestrian and <br />vehicular access to properties, to provide corridors for utilities, and for other purposes. <br />Necessary Findings for Vacation <br />In order to recommend approval of the vacation of public right-of-way. Planning Commission <br />must be able to make the following findings: <br />I. The vacation is in keeping with the public interest. <br />The vacation does not affect access to or use of any adjoining property. <br />The City has not and does not intend to develop, improve or use the dedicated <br />right-of-way as a road c.xcept for utilities and access purposes. <br />The unimproved dedicated right-of-way as it e.xisls ser\'es no public purpose. <br />2. <br />3. <br />4. <br />Public Purposes Served by Existing Right-of-Way <br />Staff has identified a number of public purposes ser\ed by the existing right-of-way proposed <br />to be vacated: <br />1. Telephone lines. <br />2. Electric power lines. <br />3. Potential Minnegasco gas lines. <br />4. Potential cable TV lines. <br />5. Provision of legal access to properties not abutting any other road or the shoreline. <br />6. Public access to properties abutting the shoreline but that have steep slopes and/or <br />bluffs making vehicular access impossible from the lakeshore. <br />7. Public access to the "park" land dedicated in the plat of Pleasant View Lake <br />Minnetonka. <br />Summary of Impacts of Proposed Vacation <br />The following represent public and private impacts if the proposed vacation is approved: <br />1. Properties to the north of Lots 22 - 24 will effectively be landlocked. <br />2. Lakeshore properties along the west side of the island will no longer have an <br />alternate rear access to the lakeshore. Such an access may be essential due to the <br />steep slopes/bluffs at the shoreline making vehicular access impossible at the <br />shoreline. <br />3. General public accessibility to the island would be permanently limited. <br />4. Existing/potential utility corridors will he lost. <br />5. Potential access to adjacent properties to the east will be eliminated.
