Kelley (hereinafter the "subdivider") on May 26, 1995, filed <br />a formal subdivision application wth the Cit>' for approval of a m o lot residential plat of property <br />legally described as: <br />Lot 2, Block 1, Bill Kelley's Land, Hennepin County, Minnesota (hereinafter <br />"the propert>’"); and <br />WHEREAS, after due published and mailed notice in accordance wth Minnesota <br />Statutes 462.358 et. seq. and the Cit\- of Orono's Zoning and Subdivision Codes, tlie Orono <br />Planning Commission held pu ’ulic hearings on June 19. 1995 and October 16, 1995. at which <br />time all persons desiring to be heard concerning this application were given the opportunity to <br />speak thereon: and <br />WHEREAS, at their regular meeting held on November 13, 1995, the Orono <br />Citv Council considered the subdivision application of the subdivider noting the following <br />findincs of fact: <br />1.The property is located within the RR-IB Single Family Rural Residential <br />Zoning District requiring a minimum of mo acres of contiguous diy fauildable <br />land within each newly created lot. <br />The property contains a total of approximately 6 dry acres. There are no <br />designated wetlands within the propeity'. <br />The proposed plat consists of two residential lots each meeting the minimum <br />requirement of two acres of dry buildable area. <br />Both lots have been found to have adequate and suitable soils for on-site septic <br />treatment facilities. <br />Page 1 of4
