Mabusth Titk Building & Zoning Administrator Administrator Reviewed:Agenda Section: Zoning Item Description: #2087 Minnegasco, Inc., 530 Old Crystal Bay Road North - Renewal Conditional Use Permit - Resolution Brief Review of Application In 1990 the City granted a conditional use permit to Minnegasco for a five year period that would ilow the temporary use of a portable vaporizer that would permit additional supplies of gas to the existing lines that would serve the northwest Lake Minnetonka area until more permanent facilities were installed. The applicant has advised that the first year the vaporizer was employed was in the winter of 1992. The facility has been used at least three times each year during extreme cold days of the winter season. The facility is only in use during the winter months. The Planning Commission questioned why more permanent solutions had not been provided as of 1995 Minnegasco representatives advised that the necessary linking of the gas lines connecting Townline Road with the Orchard Park Road system did not take place as the County had not proceeded with planned road improvements for County Road 6. It was Minnegasco ’s plan to coordinate the upgrade when the road was to be repaired in an attempt to reduce costs It is their hope that the proposed improvement will eliminate the need for the temporal^ facility. They also noted that the upgrade of County Road 6 is to be coinpleted in 1996 but that they would need an additional year (winter 1997) to be assured that the use ot the temporary gas vaporizer was no longer needed to meet the supply needs. The Planning Commission recommended unanimous approval of the application subject to the findings and conditions of the original resolution, Exhibit A, but added the condition Ih^t ^ disclaimer be included in the resolution that would state that if the lease is not renewed by VC I that the conditional use permit would expire as of that date. It would be the responsibility of the owner of the property. VCI Capital, to advise the City of the discontinuance of the lease agreement. Since the Plannine Commission meeting, the Acting Police Chief advised of specific concerns of the Lonu L^e Fire Department concerning potential safety hazards and questioned soecificallv the location of the facility and its proximity to the Orono schools. Staff has met ^ih various agents of Minnegasco at meetings in December and in January. Minnegasco has provided additional information to both the Police Department and the Fire Department representatives
