Mabusth <br />Titk Building & Zoning Administrator <br />Administrator Reviewed:Agenda Section: <br />Zoning <br />Item Description: #2087 Minnegasco, Inc., 530 Old Crystal Bay Road North - Renewal <br />Conditional Use Permit - Resolution <br />Brief Review of Application <br />In 1990 the City granted a conditional use permit to Minnegasco for a five year period that <br />would ilow the temporary use of a portable vaporizer that would permit additional supplies <br />of gas to the existing lines that would serve the northwest Lake Minnetonka area until more <br />permanent facilities were installed. The applicant has advised that the first year the vaporizer <br />was employed was in the winter of 1992. The facility has been used at least three times each <br />year during extreme cold days of the winter season. The facility is only in use during the <br />winter months. <br />The Planning Commission questioned why more permanent solutions had not been provided <br />as of 1995 Minnegasco representatives advised that the necessary linking of the gas lines <br />connecting Townline Road with the Orchard Park Road system did not take place as the <br />County had not proceeded with planned road improvements for County Road 6. It was <br />Minnegasco ’s plan to coordinate the upgrade when the road was to be repaired in an attempt <br />to reduce costs It is their hope that the proposed improvement will eliminate the need for the <br />temporal^ facility. They also noted that the upgrade of County Road 6 is to be coinpleted in <br />1996 but that they would need an additional year (winter 1997) to be assured that the use ot <br />the temporary gas vaporizer was no longer needed to meet the supply needs. <br />The Planning Commission recommended unanimous approval of the application subject to the <br />findings and conditions of the original resolution, Exhibit A, but added the condition Ih^t ^ <br />disclaimer be included in the resolution that would state that if the lease is not renewed by <br />VC I that the conditional use permit would expire as of that date. It would be the <br />responsibility of the owner of the property. VCI Capital, to advise the City of the <br />discontinuance of the lease agreement. <br />Since the Plannine Commission meeting, the Acting Police Chief advised of specific concerns <br />of the Lonu L^e Fire Department concerning potential safety hazards and questioned <br />soecificallv the location of the facility and its proximity to the Orono schools. Staff has met <br />^ih various agents of Minnegasco at meetings in December and in January. Minnegasco has <br />provided additional information to both the Police Department and the Fire Department <br />representatives
