This application is regarding variances for lot area, lot width and rear yard setback for the <br />construction of a new home. <br /> <br />2. MN§15.99 Application Deadline. The application was received June 20, 2023 and considered to be <br />complete on June 23, 2023. Therefore the 60-Day review period expires on August 22, 2023. <br /> <br />3. Background/ Summary. The applicant is proposing to demolish the existing home and construct a <br />new home in a similar location. The subject property is substandard in size and width for the LR-1A <br />Zoning District. The applicant is requesting a rear yard setback of 45 feet where 50 feet is required by <br />code. The applicant has listed topographical challenges and existing site elements which limit the <br />placement of the home. All other zoning requirements including hardcover are met. <br /> <br />4. Planning Commission Vote and Comment. On July 17, 2023, the Planning Commission held a <br />public hearing, no public comments were made. The Commission reviewed the application and noted the <br />site constraints of the lot and that the rear yard setback will be improved as the existing home is 41 feet <br />from the rear property line. The Commission voted 7 to 0 on a motion to approve the requested variances <br />as applied. <br /> <br />5. Public Comment. The applicant has provided neighbor acknowledgment forms, but no other public <br />comment has been received. <br /> <br />6. Staff Recommendation.
