The City Engineer has reviewed the future potential routes for municipal sewer <br />on the propert>*. Sewer installation for Bracketts Point is underway. The City <br />will require an easement across applicant's property for construction of the <br />proposed sewer improvements. <br />10. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />11. The City Council fmds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to prese^e a substantial <br />property right of the applicant; and would be in keeping wdth the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon the above findings, the Orono City Council hereby g^^ts variances <br />to Municipal Zoning Code Sections 10.22, Subdivisions 1 and 2; 10.55, Subdivision 8, Md <br />10.56, Subdivision 16(C) and (L) to permit the construction of additions to the existing <br />residence and revision of the roof of the existing residence, such additions and revisions <br />constituting hardcover and structure in the 0-75' lakeshore setback zone where no hardcover or <br />structure is normally allowed, and constituting additional hardcover in the 75-250' zone m <br />excess of the 25% hardcover normally in that zone, and such additions and revision <br />encroaching past the average lakeshore setback where no encroachments are normally allowe , <br />and such revisions encroaching into the 30' required side yard setback where no encroachments <br />are normally allowed, subject to the following conditions: <br />1. Hardcover in the 0-75' zone shall not exceed 3.9% per the revised site plan <br />attached to this resolution as Exhibit B. Hardcover in the 75-250 zone shall not <br />exceed 27.6% as shown on Exhibit B. Applicant shall provide updated <br />Page 4 of 8
