CHOSBY, JR, <br />ccm <br />Octobers, 1997 <br />Mr. Greg Gappa <br />City of Orono <br />PO Box 66 <br />Crystal Bay, MN 55323-0066 <br />Re: CSAH-6 Tunnel <br />Spring Hill Golf Club <br />Dear Greg: <br />I appreciate your sending to me the agreement prepared by Hennepin County <br />for the Ownership, Inspection and Maintenance of Pedestrian Underpass. <br />Consistent with the County’s earlier discussions, the County desires to deal <br />with the City of Orono and does not want to enter into a contract with a private party. <br />I envision a relatively simple agreement between Spring Hill Golf Club and the <br />City of Orono which would: <br />1 . ^ Acknowledge the existence and terms of the Hennepin County <br />agreement. <br />2. Provide for the undertaking by Spring Hill Golf Club to perform the <br />duties required of the City of Orono under the coni act. <br />3. Indemnify the City of Orono for liabilities and claims arising out of the <br />underpass. <br />4. Provide the City of Orono with the ability to perform duties undertaken <br />by Spiing Hill Golf Club if, after appropriate notice. Spring Hill Golf Club fails to <br />perform such duties; and <br />5. Grants to the City of Orono the ability to assess the Spring Hill Golf <br />Club property for costs associated with such work if, after notice, Spring Hill Golf <br />Club fails to make the appropriate payments. <br />Minmupolis Denver Des Moines LonAon Frankfurt Almaty
