7080.0040 [Repealed, 20 SR 1995]7080.0050 [Repealed, 20 SR 1995]MINIMUM TECHNICAL STANDARDS AND CRITERIA FOR INDIVIDUALSEWAGE TREATMENT SYSTEMS7080.0060 COMPLIANCE CRITERIA.Subpart 1. Treatment required. Each individual sewage <br />treatment system shall be designed to receive and treat all <br />sewage from the dwelling or other establishment served. <br />Subp. 2. Band carried greyvater. Hand carried greywater <br />shall not be discharged directly to surface waters, <br />drainageways, or in a manner harmful to the environment or to <br />Subp. 3. Compliance. Individual sewage treatment systems <br />shall be considered in compliance if: <br />A. an existing individual sewage treatment system is <br />not a failing system as defined in part 7080.0020, subpart 16a; <br />or <br />B. new construction or replacement meets the <br />technical standards and criteria defined in part 7080.0020, <br />subpart 46a. <br />Required upgrade. Systems not in compliance <br />shall be upgraded, replaced, repaired in compliance with this <br />part, or discontinued. If a compliance inspection indicates <br />that a system presents an imminent threat to public health or <br />safety as defined in part 7080.0020, subpart 19a, the owner must <br />upgrade, replace, or discontinue use of the system within the <br />time period established by the local unit of government in areas <br />with local ordinances and by the agency in areas without local <br />ordinances. This time period shall not be longer than ten <br />months after the owner receives a notice of noncompliance. <br />SA: MS s 115.03; 115.55; 115.56 <br />HIST: 13 SR 2 n <br />7080.0065 PROHIBITIONS. <br />A. Sewage, sewage tank effluent, or seepage from a <br />soil treatment system shall not be discharged into any well or <br />boring as defined in chapter 4725 or any other excavation in the <br />ground not in compliance with this chapter. <br />B.
