Application <br />TOis Item was tabled at the July meeting to allow applicant to revise and amend the application. <br />Applicants have formally applied for the vacation of dedicated public right-of-way and park, and <br />have revised their variance application to include lot area and width as well as hardcover for the proposed layout. lui uic <br />Vacation of Road and Park Areas <br />After reviewing *e right-of-vvay issue, Public Works and Zoning staff concluded that the existing <br />40 nght-of-way for Spruce Place should not be vacated, but the dedicated roadway east of the park <br />between its north and south extremities, could be vacated. This results in the City retaining its <br />ability to relocate Spruce Place further north and off of the property to the south of the park, if that <br />tecomes necessa^ for some reason in the future. While there is no intent to move Spruce Place, the <br />tact that It IS partirfly encroaching on the property to the south suggests that the City should leave <br />Its options open. T^s reduces the size of the area to be vacated to approximately 9,000 s.f„ which <br />IS stdl larger than the 7,000 s.t portion of Lot 5 and vacated Portland Place to be dedicated back to
