ORDINANCE NO. 122 , SECOND SERIES <br />m <br />AN ORDINANCE TO AMEND THE MimCIPAL ZONING <br />CODE AND SUBDIVISION CODE BY DEFINING <br />STANDARDS FOR IHE CREATION AND USE OF LOTS <br />WmCH DO NOT ABUT A PUBLIC OR PRIVATE ROAD <br />THE CITY COUNCIL OF ORONO ORDAINS AS FOLLOWS: <br />SECTION 1. Municipal Zoning Code Secdon 10.02 and Municipal Subdivision <br />Code Section 11.03, Subdivision 2 are each hereby amended by adding the following definidons: <br />"Loc-BacJc" - A lot typically separated from a public or private road by another lot and <br />which gains access to the public or private road via a naixow corridor. Such a separated <br />lot is considered to be a "back lot" when the corridor is platted as an outlot. A separated <br />lot is considered to be a "flag lot" when the corridor is platted as pan of the lot. When <br />the corridor is merely an easement over another lot, the separated lot is considered to be <br />an "easement back lot". <br />f dirfct super- <br />iiryeyor under <br />I <br />"Lot-Front" - A lot abutting a public or private road, across which an outlot has been <br />platted for access to a back lot. <br />SECTION 2. Municipal Zoning Code Section 10.03 is amended by adding <br />Subdivision 27 which shall read as follows: <br />Subd. 27. Special Standards for Back Lots Created After January 1, 1994. Back lots <br />as dermed in this section which were created as part of a subdivision that received <br />preliminary subdivision approval after January 1, 1994 are subject to the following <br />special requirements in addition to the standards required in Section 11.31, Subdivision <br />5 of the Orono Subdivision Code: <br />A. Dimensional standards for back lots shall be as follows: <br />1. Lot area shall be 150 5T of the zoning district requirement. <br />2. Lot width measured parallel to the front or street lot line at the <br />street yard setback line of a lakeshore back lot, or at the front yard <br />setback line of a nonlakeshore back lot, shall meet the zoning <br />district width requirement. The street yard or front yard for any <br />back lot will be a yard starting where the narrow access outlot <br />corridor ends and the lot begins. Lakeshore back lots shall meet <br />the lot width standard at the shoreline, at the lakeshore setback <br />line, and at the street yard setback line. <br />3. , The depth of the required street yard or front yard shall be 150% <br />of the zoning district front yard requirement- <br />• <br />4. The required side yard and rear yard depths for back lots sliall be <br />150% of the zoning district yard requirements. Tne required <br />lakeshore yard of a lakeshore back lot shall meet the zoning <br />district lakeshore yard requirements.
