#2263 Brook Park Realty <br />July 17,1997 <br />Page 2 <br />Section 10.60 Subd. 2 disallows density in excess of 4.0 units per acre of dry <br />buildable land; dry buildable land = ± 7 acres (wetlands to be delineated); 7 x 4.0 = 28 units <br />allowed. <br />Section 11.10 Subd. 14 prohibits the granting of variances to the density provisions <br />of the Code. <br />Wetlands: <br />A wetland in the southerly 1/3 of the site is approximately 3 acres in area. No wetland delineation <br />report has been submitted. This wetland appears to be subject to an existing Flowage and <br />Conservation Easement, Doc. #4763090. <br />nie cunent welland boundaries appear in the field and in the submitted site plan to differ frotn the <br />easement boundary. Also, a portion of this wetland on applicants property appears to possibly have <br />been illegally filled by the adjacent property owner to the west. This issue must te addressed, an <br />restoration may be an appropriate condition of plat approval if filling has ocurred. <br />The wetland extends across nearly the entire width of the property adjacent to Shoreline Drive <br />Provision of utilities from Shoreline Drive may require easements from adjacent todowners o <br />installation through the wetland or some alternate route. <br />Once the extent of actual delineated wetlands is known, a detemiination wiil have to te made <br />whether the existing Flowage & Conservation Easement is adequate or must be expanded <br />defined. <br />Hardcover Limitations <br />The LR-lC-1 PRD standards limit site hardcover to 35%, even though the developable portion of <br />the site is more than 1,000' from the shoreline of Lake Minnetonka. <br />Engineering Issues <br />The City Engineer has provided a letter regarding access, drainage, utilities and easements (See <br />attached Exhibit H). <br />Sewer & Water Connection Charges <br />Preliminary review by staff indicates that municipal water has been hilly assessed to the prope^ <br />and no connection charge will be due. Municipal sewer was only mimmally assessed to the property <br />and a connection charge estimated at $3800 per unit will be required. <br />'4
