} <br />A RESOLUTION AUTHORIZING THE PERMANENT AND <br />TEMPORARY TAKING OF LAND BY EMINENT DOMAIN FOR SANITARY <br />SEWER PURPOSES FOR THE <br />NORTH LONG LAKE SANITARY SEWER PROJECT <br />WHEREAS, the City Council has ordered preparation of a resolution authorizing taking of <br />land by eminent domain for sanitary sewer purposes at the location hereinafter specified, <br />THEREFORE, BE IT RESOLVED, by the City Council of Orono: <br />1. That it is hereby determined that the taking of the parcels of land at 1490 Long Lake <br />Boulevard is necessary for the public good in order that said parcel shall be devoted to sanitary sewer <br />purposes. <br />2. That the City shall take by right of eminent domain for sanitary sewer purposes, the land <br />described below, and the City Attorney be hereby authorized and directed to commence proceedings <br />in the District Court of Hennepin County for appointment of Commissioners to determine the <br />damages, if any, sustained by the respective owner and interests of the parcel affected by such <br />taking, as authorized by law. <br />That the land above referred to is more particularly described as follows: <br />TEMPORARY CONSTRUCTION EASEMENT <br />A temporary easement for construction purposes over, under and across the west fifteen (15) feet of <br />the east twenty-five (25) feet of the property described as the east 60 feet of west 735 feet of south <br />175 feet of southwest quarter of section 26 and lots 3 and 4, Albee's Long Lake Addition according <br />to the map or plat thereof on file and of record in the office of the County Recorder, Hennepin <br />County, Minnesota. Said temporary easement shall expire automatically on December 31, 1997, <br />without the need of further recording. <br />Page 1 of2
