Background: <br />In 1984, Mr. Schneider obtained a conditional use permit to allow the continuation of a non- <br />conforming use of the structure for a fine arts school providing full-time class instruction. A <br />variance was also granted to allow parking in a required side yard. <br />The proposal is a change from one non-conforming use to another and an amendment to the <br />conditional use permit is required per the resolution that was adopted in 1994. Additionally, the <br />Building Official has indicated that the occupancy classification would change from a "B2" to a "E2" <br />which requires improvements to the building for handicap access and life safety standards. <br />Proposed Use: <br />Staffing and Capacity <br />The Lake Minnetonka Environmental School proposes to have 2 or 3 classes with 14 students in <br />each class for a total of 52 students. The staff would consist of 3 or 4 teachers. Projected growth <br />would be 56 students and 5 teachers. <br />Hours of Operation and Parking <br />The school year would be weekdays from 8 a.m. to 3:30 p.m., September through June 15. Parking <br />for staff is available on the north side of the building. A drop-off area is available next to the <br />building. All students currently arrive by private passenger vehicle. However, some may be bussed <br />in the future. <br />Classroom Plan <br />The two main floors would be classrooms, the upstairs will have classroom, library and computer <br />room. The Building Official has indicated that a certificate of occupancy shall be obtained before <br />the school can move into the building. Fire sprinklers, handicap accessibility, and <br />handrails/guardrails will need to be approved by the Building Official before the school can occupy <br />the building. The school’s plans will need to be prepared by an architect. No variance procedure is <br />available to waive Building Code requirements for public health/safety requirements and handicap <br />accessibility. <br />#2235, Martin B.
