April 10, 1997 <br />Page 7 <br />#2212 Rebers - Preliminary Subdivision <br />attorney. Planning Commission voted 5-0 to recommend preliminary plat approval subject to the <br />following: <br />Right-in, right-out access is acceptable for development of Outlot E (Lot 1) subject <br />to mture elimination of said access as noted below. <br />1. <br />2.Applicant shall pay costs of future road and/or bike trail on the north side of the <br />property (in Outlot D) when the road and/or bike trail are developed. <br />3.Applicant to plat the additional triangular portion of right-of-way and grant the <br />appropriate road/trail/drainage/utility easements over it as well as drainage and <br />utilities easements over Outlot D. <br />4.Owner of Outlot E (Lot 1) shall be bound by whatever access requirements the City <br />establishes at the time of further development along the Highway 12 corridor (i.e. <br />when Outlot F develops, or whe»' Fast Willow Woods Lot 2 is developed). <br />5.At the time a frontage road to the rear of Outlot E (Lot 1) is developed, the right- <br />in, right-out access to 12 must be eUminated. <br />Planning Commission also suggested that applicant investigate the possibility of a shared curb cut <br />with the Wear property, as well as the possibility of creating an access across from Brimhall <br />Avenue which would serve both Outlot E and the East Willow Woods future development. <br />Summary of Staff and Planning Commission Recommendations <br />The Planning Commission recommendation is to allow the development of Outlot E prior to <br />construction of the frontage road, allowing temporary use of a right-in, right-out access directly <br />to Highway 12 until such time as a frontage road is constructed as a result of development of <br />commercial properties to the east or west. <br />Staff recommends that the development of Outlot E not be allowed until a frontage road is <br />constructed to either Willow Drive or Brown Road, which are/will be signalized intersections. <br />The option of accessing directly across from Brimhall is not preferred by staff because it would <br />add uncontrolled cross traffic at a point midway between two signalized intersections. The use of <br />right-in, right-out access to this site on a temporary basis would not be in keeping with the City's <br />Comprehensive Plan and would in staff's opinion create an unsafe condition. <br />COUNCIL ACTION REQUESTED: <br />Adopt attached preliminary plat approval resolution per staff recommendation direct staff to <br />draft a resolution per Planning Commission recommendation.
