Request for Council Action continued <br />page 5 of 7 <br />February 21, 1997 <br />Zoning File #2204 <br />As already noted above, there is no future extension road leading from the north to the Fullerton <br />propert>’. The cul-de-sac will be approved at a 1,600' length with a potential of 8 residential units <br />to be serv'ed by the private road. <br />Planning Commission Recommendation <br />The Planning Commission unanimously approved the subdivision application of a 5 lot plat, <br />Fullerton Estates, finding all standards of the LR-IA Zoning District, subdivision regulations for <br />Class III subdivision and septic code have been satisfied. Approval shall be subject to the following <br />conditions: <br />1. <br />2. <br />4. <br />5. <br />6. <br />7. <br />Applicant to create covenants providing for the protection of the Type 2 wetland <br />within Lot 3. <br />Primary and alternate septic sites on Lots 1,2 and 5 shall be fenced off and protected <br />prior to any land alterations. <br />The two accessory stmctures within Lot 2 and accessory structure that encroaches the <br />shared lot line of Lots 3 and 4 shall be removed prior to final plat approval. If <br />structures have not beer .amoved at the time applicant applies for final plat approval, <br />applicant shall agree to enter into a developer's agreement and post an acceptable <br />form of security to ensure structures are removed before a building permit is issued <br />for new residential construction. <br />Applicant to grant drainage easements over retention pond and drainage way that is <br />located within Lots 1 and 2. <br />Applicant to grant drainage and utility easements 10' wide along tlie perimeter of all <br />lots and 5' along the shared lot line. Easements may be omitted at the shoreline. <br />All new residential construction shall be subject to the shoreland regulations as set <br />forth in Section 10.56 of the Municipal Code. <br />Applicant's engineer and Orono staff shall determine what sections of roadway may <br />be less than a 24' paved width. In order to preserve existing amenities. The <br />following safety improvements must be included with final road plans: <br />A.Roadway to be upgraded to a 22' width with curbing for a 500' section <br />located between stone retaining walls. <br />i
