6. <br />7. <br />8. <br />decision by the RGU or any other governmental unit to deny approval of <br />the project pursuant to Minnesota Statutes Section 116 (D.04), Subdivision <br />6 in the event that the EIS should reveal that the project would be likely to <br />cause "pollution, impairment, or destruction" of the environment and that <br />there is a "feasible and prudent" alternative to the project. This conditional <br />approval shall not preclude the RGU or any other unit of government from <br />choosing another alternative or the "no build" alternative" over the project <br />as proposed because of environmental reasons consistent with State law. <br />D.The City shall not issue a land alteration permit for this project until such <br />time that the environmental review process is complete. <br />E.The City of Orono reserves the right to review this conditional approval <br />should the City find that there are significant changes to the project <br />proposed as a result of the envmfmfiteiitaf'icwg <br />Authorities granted by this resolution are permissive only and must be exercised <br />by application for land alteration permit within one year of the date of Council's <br />approval, or the special conditions of this resolution will expire on that date <br />(February 10, 1997). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the Zoning Code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicant has read, understood and hereby agrees to the terms of <br />this resolution and on behalf of Hennepin County. <br />Page 6 of 8 <br />J
