grants variances to Municipal Zoning Code Sections 10.56, Subdivision 16 (J) and (K) and 10.55, <br />Subdivision 8 .o allow the filling of City designated wetlands where no filling is normally <br />allowed, and for a conditional use permit per Sections 10.03, Subdivisions 19-21 and 10.55, <br />Subdivisions 8-14 to allow land alterations in excess of 100 cubic yards and within and adjacent <br />to protected wetland and flood plain areas, subject to the following conditions; <br />1. <br />2. <br />3. <br />• ,1J .i.'. - ■ 'i <br />4. <br />5. <br />Applicants shall obtain a land alteration permit from the City of Orono prior to <br />commencement of this project. <br />Applicants shall adhere to the construction plans approved by the City Council on <br />December 9, 1996, a set of which plans are of record at the City offices. <br />Applicants shall adhere to the approved erosion control rJ ' and shall use Best <br />Management Practices during all phases of constructioiv. <br />'i <br />Applicants shall obtain the necessary approvals from other government agencies <br />prior to commencing the project, and shall complete the mitigation measures in a <br />timely manner as proposed. <br />Because this project is subject to an Environmental Assessment Worksheet process <br />which has not been completed at the time of adoption of this resolution, this <br />approval is specifically conditioned as follows: <br />A. This approval does not preclude the imposition of changes in the project or <br />mitigation measures that would reduce or avoid environmental impacts that <br />are disclosed in the EAW, comments received on the EAW, the EIS if an <br />EIS is prepared, and comments received on the EIS; <br />B. This conditional approval shall not and must not prejudice the decision on <br />the need for an EIS, and therefore this approval is conditioned on <br />completion of the environmental review process in accordance with <br />Minnesota Rules Part 4410.3100, Subpart 1 rather than on the decision that <br />an EIS is not necessary; and <br />C.
