A RESOLUTION DENYING A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 21 AND DENYING <br />VARIANCES PER MUNICIPAL ZONING CODE <br />SECTIONS 10.22, SUBDIVISION 2; 10.55, SUBDIVISION 8; AND <br />10.56, SUBDIVISIONS 16(1), (J) AND (L) <br />FILE #2196 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, pursuant to State Statutes 412 et. seq. and 462 et. seq., the City Council <br />of the City of Orono has adopted zoning regulations for the protection of the public health, safety <br />and general welfare; and <br />WHEREAS, Genmar Industries, Inc. (hereinafter "the applicant") is the owner of the <br />property located at 1449 Shoreline Drive within the City of Orono (hereinafter "the City") and <br />legally described as follows: <br />Exhibit A attached vnercinafter "the property"); and <br />WHEREAS, the applicant has applied to the City of Orono for a conditional use <br />permit and variances to permit the construction of a 28 stall parking lot on the west side of Shoreline <br />Drive, requesting the following specific approvals: <br />1. Conditional use permit for land alteration in excess of 100 cubic yards per Section <br />10.03, Subdivision 21. <br />Variance for land alterations within 75’ of the shoreline of Lake Minnetonka per <br />Sections 10.22. Subdivision 2; 10.55, Subdivision 8; and 10.56, Subdivision 16(J). <br />3. Variance for hardcover within 75' of the shoreline where no hardcover is normally <br />allowed, and for hardcover in the 75-250' lakeshore setback zone in excess of the <br />normal 25% hardcover allowance, per Sections 10.22, Subdivision 2; 10.55, <br />Subdivision 8; and 10.56, Subdivision 16(L). <br />Page 1 of 9
