A RESOLl TION CONFIRMING THE CITY'S INTENT <br />TO NOT RE-ASSESS LOT 23, BLOCK 7, CRYSTAL BAY VIEW <br />FOR 1963-1965-1970 SEWER AND WATER IMPROVEMENTS <br />WHEREAS, Lot 23, Block 7, Cr> stal Bay View, Hennepin County, Minnesota was <br />acquired by the City of Orono in 1977 through tax forfeiture, retained by the City for Park and <br />Recreation purposes; and <br />WHEREAS, at the time of forfeiture, there was an outstanding spe J assessment <br />balance on the property of $1,535.13 for the 1963-lB interceptor sewer, 1965 LS-1 lateral sewer, <br />and 1970 LW-1 watermain improvement projects; and <br />WHEREAS, on September 9, 1996 the Orono City Council adopted Resolution <br />#3768 authorizing the reconveyance of a 20 ’ x 100' portion of said Lot 23 to the County and <br />approving public sale of said portion to adjacent property owners; and <br />VV HEREAS, a portion of the $ 1,513.13 special assessment balance will be recouped <br />by the City as a result c>f said public sale; and <br />WHERE.AS, because said Lot 23 including the 20 ’ x 100’ portion released for pub’ic <br />sale is not suitable for development of a residence due to acreage and wetland limitations, the <br />property has not a id will not fully benefit from the previously assessed sewer and water <br />improvemciili, and it would therefore be unreasonable to re-assess the property to recoup any portion <br />of the prior unpaid assessments that are not recouped as part of the County’s public sale process. <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of Orono, <br />Minnesota that the City intends to not re-assess Lot 23, Block 7, Crystal Bay View for 1963-1965- <br />1970 sewer and water improvements. <br />Adopted by the City Council of Orono, Minnesota this 27th day of January, 1997 by a vote <br />of____ayes and ____nays. <br />ATTEST:Gabriel Jabbour, Mayor <br />Linda S.
