GafTron <br />Title: Administrative Projects Coordinator <br />Agenda Section: <br />City Administrator <br />Item Description: Handlin Tax Forfeit Sale, 3860 North Shore Drive - Waive Sev,er & <br />Water Reassessment <br />On September 9, 1996 Council released a 20' x 100 ’ portion of City property for sale to Handlin to <br />accomodate his existing driveway. This property had c*f,ginally been acquired by the City through <br />a tax forfeiture in 1977, and the portion not being purchased by Handlin is mostly wetland. <br />At the time of tax forfeiture there v.os an outstanding special assessment balance on the property of <br />$1,535.13 for the 1963-lB interceptor sewer, 1965 LS-1 lateral sewer, and 1970 LW-1 watermain. <br />Mr. Handlin's purchase price for the portion he is acquiring is $2,000. Of this amount, <br />approximately 30%-50% will go toward County processing costs and the remainder toward this old <br />special assessment, hence the City will likely recoup some significant portion of the assessment. <br />Mr. Handlin has requested that the City c^nOtr;; it will not then re-assess the remaining balance of <br />the old assessments, which would exceed ;>udget for this project. Indeed, the City has the right <br />to such a reassessment of the portion nc: paid from the proceeds. However, it would seem unfair <br />to attempt to recover old assessments for which the bonds were paid off long ago, especially since <br />this 20' X 100 ’ property never really benefitted from sewer or water. <br />Staff Recommendation <br />Staff has drafted a Resolution confirming for Mr. Handlin that the City has no intent to re-assess the <br />20'xl00' parcel for the 1963-65 sewer projects nor the 1970 water project. <br />Council Action Requesb.d <br />Adopt the attached resolution. <br />Proposed Motion: Moved by , seconded by , to adopt Resolution No. <br />Confirming City's Intent to Not Re-Assess Lot 23, Block 7, Crystal Bay View for 1963-1965-1970 <br />Sewer and Water Improvements.
