3. <br />4. <br />The Orono Planning Commission reviewed this application on January 21, 1997, <br />and recommended unanimous approval of the variances as proposed based upon <br />the following unique findings and hardships: <br />A. In October of 1973, the Dicon Addition was approved by the City. All <br />3 residential lots within the plat met the required standards of the <br />existing R-IC Zoning District. <br />B. In 1974 at the time of the issuance of a building permit for the existing <br />residence structure on the property, the structure met all required setbacks <br />of the R-IC Zoning District. <br />C. Resolution #3653 adopted by the Orono City Council on December 11, <br />1995 granted a lot area and lot width variance to the subject property at <br />the time of a subdivision of a lot line rearrangement. <br />D. The property measures 100’ at the legal building site. If a new residence <br />was installed to meet all the required setbacks of the current LR-IA <br />Zoning District, the structure would be limited to a 40' width. <br />E. No hardcover exists within the 0-75' or 75-250’ setback areas on this <br />property. <br />F. The proposed new residence and accessory improvements will not extend <br />beyond the defined average lakeshore setback line. <br />G. Structural coverage will not exceed the allowed 15% at 8,541 s.f. <br />Structural coverage is currently proposed at 4,680 s.f or 8.2%. <br />H. The property is served by municipal sewer. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />Page 2 of 5
