A RESOLUTION GRANTING <br />VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.23, SUBDIVISION 6 (B) AND <br />SECTION 10.22, SUBDIVISION 2 <br />FILE #2200 <br />WHEREAS, William H. Ellis and Carmelita W. Ellis (hereinafter "the <br />applicants") have an interest in the property located at 2435 North Shore Drive within the City <br />of Orono (hereinafter "City") and legally described as follows: <br />Lot 3, Block 1, Scotch Pine Addition, Hennepin County, Minnesota (hereinafter "the <br />property"); and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.23, Subdivision 6 (B) to permit construction of a residence on a <br />property that consists of 56,938 s.f. or 1.3 acres where 87,120 s.f. or 2 acres is required, the <br />lot width measures 127' at the shoreline and 120' at the 75' setback line where the code would <br />require 200', the structure will be located 16.2' from the east side lot line and 13.5' from the <br />west side lot line where the code would require 30'. <br />The application also includes a variance to Section 10.22, Subdivision 2 as <br />proposed improvements will require a hardcover variance within the 250-500' setback area <br />proposed at 8,877 s.f. or 36.5% where 36.6% exists and where the code would allow 30%. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #2200. <br />2. The property is located in the LR-IA Zoning District requiring 2 acres in area. <br />Page I of 5
