The City has received no negative comments from the <br />residents notified of the proposed variances <br />Statement of Hardship <br />Please refer to Exhibit B, hardships are reviewed as follows: <br />1 . At the time of the original subdivision in October of 1973, all three residential lots met the <br />standards of the R-IC Zoning District. <br />2. <br />3. <br />5- <br />6. <br />7. <br />In 1974 at the time of the issuance of the building permit, the existing structure met all <br />required setbacks of the zoning code. <br />Resolution #3653 adopted by the City Council on December 11, 1995 granted a lot area and <br />lot width variance to the subject property. <br />The lot measures 100’ at proposed building site. If a new residence was installed meeting <br />the required side setback, the structure would be limited to a 40' width. <br />There are no excesses of hardcover within the other setback zones. Applicants have <br />maintained hardcover at the existing level of hardcover proposed at 36.5%, existing 36.6%. <br />The existing residence and accessor>- improvements within the lakeshore yard will not extend <br />beyond the average lakeshore setback line. <br />Structural coverage will not exceed the allowed 15% at 8,541 s.f. Structural coverage is <br />proposed at 4,680 s.f or 8.2% <br />8, The property is served by municipal sewer. <br />The Planning Commission was asked to consider if reductions in hardcover in the 250-500' setback <br />area were needed. They were also asked if the east and west side setbacks should be increased to <br />more closely conform to current code. The Planning Commission felt the application as proposed <br />was acceptable finding the excesses of hardcover located some 250’ from the shoreline and side <br />setbacks consistent with existing residence and structural improvements on adjacent properties in <br />subdivision.
