Plumbing in Accessory Structures <br />July 16.1998 <br />Page 4 <br />Staff Recommendation <br />Staff would recommend a combined regulation as follows: <br />A. <br />B. <br />Staff authorized to issue permits for water supp ly plumbing in accessory buildings. <br />Any wastewater plumbing in an accessory building will require that a covenant be filed in <br />the title including the following agreements: <br />1. Accessory building will not be used fyt^ome occupation except ifi'when <br />specifically approved by City, a <br />Accessory building will not be used as a dwelling unless a guest house CUP <br />is obtained. <br />2. <br />3. Accessory building will not be rented out as a dwelling under any <br />circumstances. <br />C.Wastewater plumbing that includes a tub or shower will require a CUP. A conditional use <br />to be termed "Plumbing in Accessorj^S^ruefi&e" will be added to the R-1A list of conditional <br />uses, and will require that the owner execute a covenant as noted in B above. The value in <br />adding this new conditional use is that it would allow full plumbing without having to meet <br />the "double lot area" standard that is required for a guest house. The CUP and covenant <br />would give the City clear enforcement authority if the conditions were violated. Also, the <br />City could avoid being in the position of having to grant lot area variances or deny a guest <br />house application when the lot is too small and there is no intent to use it as a guest house. <br />To this end, proposed code revisions are attached as Exhibit A. <br />Planning Commission Action Requested <br />Provide staff with direction regarding the proposed amendment. <br />«:
