r <br />A. <br />B. <br />C. <br />D. <br />4. <br />CITY of ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. 4 1 8 <br />The variances are required to preserve , a substantial interest in the <br />property. <br />No other location exists on the lot where a garage can be located. <br />The garage replacement does not increase the amount of hardcover <br />beyond the amount that previously existed nor further encroach into the <br />side yard setback than the former garage. <br />The zoning lot does not conform to minimum zoning requirements for <br />the LR-IB district. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicants, but is necessary to a leviate a <br />demonstrable hardship or difficulty; is necessary to preserve a subst^tial <br />property right of the applicants; and would be in keeping with the spint and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed vanance on the health, salety <br />and welfare of the community. <br />• • <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />giants variances to Municipal Zoning Code Section 10.24, Subdivision 5 P) “d Se«^ <br />IS^division 2 to allow 31.75% hardcover in the 250-500' setback where <br />to allow a side yard setback of 6.16' where 10' is required to pemut <br />24’x26 ’ garage in the same location as the previous garage that was destroyed by fire. <br />Approval was subject to the following conditions: <br />1. The existing shed encroaches in the required rear yard setbacks. If sh'd is <br />destroyed, it shall not be allowed to encroach in the required yard or mere <br />in size. <br />5. <br />Page 2 of 4
