Conditional Use Permit <br />Staff has determined the landscaping that has occurred on the property required fill to be added to <br />stabilize the outcroppings on the lot. Before the landscaping the hill was grass that the applicant has <br />stated was difficult and dangerous to maintain. <br />Findings: <br />1 . That the proposed location of the conditional use is in accord with the objectives of the <br />Zoning Chapter and the purposes of the district in which the site is located and <br />Comprehensive Municipal Plan. <br />The improvements to the property would not change the use of the property. The <br />property would remain residential. <br />2. <br />3. <br />That the proposed location of the conditional us? and the proposed condition under <br />which it would he operated or maintained wot id not be detrimental to the public health, <br />safety, or welfare, or materially injurious to pryperties or improvements in the vicinity. <br />The location of the conditional use would not be detrimental to public health. The <br />property owner installed the landscaping as a result of having a steep hill that was <br />dangerous to mow. <br />That the proposed conditional use will comply with each of the applicable provisions of <br />the Zoning Chapter. <br />The amount of dirt placed for landscaping was minimal. The boulders will have the most <br />impact as they are visible from the lake. The intent of the Shoreland Ordinance is to <br />restrict alterations within the lakeshore area.
