The property can continue to be used without a garage. However, the previous seasonal <br />cabin has been changed into a year round residence. It may be considered a hardship to <br />not have a garage on the property, however, the applicant was instructed that ^ture <br />hardcover would be limited <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The situation is created by the existing amount of hardcover that was built into the <br />0-75' setback area which is credited against the 75 ’-250' setback. The applicant <br />chose to not build the house and garage at the same time. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The variance will increase the amount of hardcover on the lot. Most of the properties <br />in the area have garages. <br />4. <br />5. <br />6. <br />7. <br />The special conditions applying to the structure or land in question are peculiar <br />to such property or immediately adjoining property. <br />The zoning lots in this area do not meet lot width and lot area standards. All of the <br />lots are subject to the same hardcover limits but most were constructed before the <br />existing requirements. The subject lot also has a portion of the lot located in a floodplain, <br />however, this does not impact the siting of the garage. <br />The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />The other lots in the area are subject to the same conditions, however, the amount of <br />hardcover on this lot is subject to the conditions of the previous resolution. <br />The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />The applicant will need to provide testimony that he has a substantial interest in having <br />a garage. <br />The granting of such variance will not merely serve as a convenience to the applicant, <br />but is necessary to alleviate demonstrable hardship or difficulty. <br />#2390 David Rahn <br />1385 Rest Point Road <br />July 20,1998 <br />page~4
