The application is for plumbing in an <br />accessory structure which the Code does not address. In the past plumbing in an <br />accessory structure has been defmed as a guest house. <br />The Board or Council may permit as a variance the temporary use of a one-family <br />dwelling as a two-family dwelling. <br />The applicant will not be changing the dwelling status of the property. Mr. and Mrs. Kluth <br />have agreed to place a restrictive covenant on the deed to run with the land which would <br />prohibit the use of the building as any sort of living quarters. <br />The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining property. <br />The property contains a drainage pattern that would be impacted by extending the residence. <br />The conditions do no apply generally to other land or structures in the district <br />in which said land is located. <br />The residence is built into a hill and water naturally flows from the higher southwest comer <br />of the lot to the northeast comer. <br />The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />The lot could support an addition to the home absent of a drainage problem. To maximize <br />livable space without interrupting the natural water flow the applicant is constmcting an <br />accessory structure separate from the principal. <br />The granting of the proposed variance will not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary to the intent of the Zoning Code. <br />The game building will be required to meet all furrent building code requirements. The <br />stmcture will have plumbing and heating. It will not have a detrimental effect on adjacent <br />properties. <br />The granting of such variance will not merely serve as a convenience to the applicant, <br />but is necessary to alleviate demonstrable hardship or difl&culty. <br />«2389DmlelJ.
