The primary buildability issue is whether Lot 64 should be <br />granted a lot area variance absent legal combination with the 5 additional parcels. <br />A secondary buildability issue is the location of the new stmcture within Lot 64. Any 'grandfather' <br />rights that may have accmed to the old cabin are no longer valid given that it has been totally <br />removed. It is unlikely that the City Council would grant an after-the-fact lakeshore setback <br />variance for the new cabin given that the 'hardship' is entirely self-created. <br />A violation citation is enclosed requiring you to appear in court. It is the City's intent that the <br />offending stmcture be removed. If it is not removed by September 1, further legal action will be <br />taken. However, if you wish to apply for a lot area variance and would consider moving the cabin <br />to a conforming location if a lot area variance is granted, then there may be a basis for delaying <br />removal.
