Yaeger <br />15694 Sussex Drive <br />Minnetonka, MN 55345 <br />Re: Construction at 310 Big Island (PINS # 23-117-23 32 0028, AKA Lot 64, Morse Island Park) <br />Dear Mr. Yaeger: <br />During an inspection of Big Island on July 30, 1997 it was discovered that a new cabin is under <br />construction on the above referenced property. According to Hennepin County Tax Records you are <br />the owner of this property. <br />This construction is in violation of a number of City ordinances, and therefore a STOP WORK <br />order has been posted on vhe building. This building must be removed and the site restored <br />no later than September 1,1997. <br />_ <br />The construction of this cabin is a violation of City ordinances for a variety of reasons, including but <br />not necessarily limited to the following:. <br />1. <br />2. <br />3. <br />4. <br />A building permit is required for construction of this building. No building permit has been <br />applied for, and none has been issued. <br />The building is located less than 75' from the shorelin'^ where no construction or hardcover <br />is allowed per City Ordinances. <br />• • • <br />The property in question is not considered by the City as a buildable lot except in conjunction <br />with 5 additional tax parcels (23-117-23 32 0029; 23-117-23 32 0046; 23-117-23 32 0047; <br />23-117-23 32 0048; and 23-117-23 32 0049) which in combination with your parcel <br />constitute Record Lot #15 per City of Orono Ordinance #246 adopted December 30,1982. <br />Your property as a separate tax parcel has not been granted the necessary lot area variance <br />which would be required for it to be buildable. <br />The issues surrounding the buildability of this parcel date back to 1982-83 and likely will not be <br />easily resolved due to the many property owners involved.
