Criteria fi*r Determining Undue Hardship <br />1. <br />2. <br />4. <br />5. <br />6. <br />7. <br />8. <br />The property in question cannot be put to a reasonable use if used under conditions allowed <br />by the official controls. <br />The existing residence can continue to be used, however, the applicant has indicated that the <br />bedroom is small. <br />The plight of the landowner is due to circumstances unique to his property not created by the <br />landowner. <br />The situation is created by the location of the existing residence, the topography of the lot <br />and the proposed design. <br />3. The variance, if granted, will not alter the essential character of the locality, <br />The variance for side yard setback will not change the character of the area. <br />Economic considerations alone shall not constitute an undue hardship if reasonable use for <br />the property exists under the terms of this chapter. <br />Economic factors may be a consideration with this application. <br />The special conditions applying to the structure of land in question are peculiar to such <br />property or immediately adjoining property. <br />The property is surrounded by Hackberry Park. The variance would not negatively impact <br />the park. <br />The conditions do not apply generally to other land or structures in the district in which said <br />land is located. <br />The side yard setback requirement of 10' applies to all residences in this zoning district. <br />The granting of the application is necessary for the preservation and enjoyment of a <br />substantial property right of the applicant. <br />The applicant has indicated that the master bedroom is small. The addition will increase <br />the size of the room.
