The Vciriances, if granted, will not alter the essential character of the locality. <br />4. <br />5. <br />6. <br />7. <br />The variance for lot area will not change the character of the area. <br />The variances for side street setback and hardcover may have a negative effect on the <br />neighborhood. <br />Also, the proposed garage would have doors that face the lake. This is not desirable and <br />would have a negative effect on views from the lake. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for 2iny use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />A single family residence is permitted in this zoning district. <br />The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining property. <br />Most lots on Loma Linda Drive were platted prior to current zoning requirements and do <br />not meet lot area standards. <br />While several other lakeshore properties in the vicinity have been granted variances for <br />setbacks and hardcover for new residences and improvements to existing residences, most <br />of these lots have been significantly smaller and narrower. <br />The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />Most lakeshore lots in the immediate vicinity are smaller and narrower. Therefore <br />variances are necessary from setback and hardcover requirements. This is not the case with <br />the subject property because the average width nearly conforms to the lot width requirement. <br />The lot area is greater than most lakeshore lots in the immediate vicinity. <br />The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />A reasonable residence can be built upon the subject property that would require only one <br />variance for lot area. <br />U236I William Bockmann <br />1130 Loma Linda Avenue <br />yanances <br />April 20. 1993 <br />Page A
