6. <br />7. <br />The variances will allow a residence to be reconstructed on site with a similar footprint. The <br />only substantial difference is that the garage is proposed to face south and be connected to <br />the main level rather than a tuck under. This is an improvement for accessibility for the <br />occupants. <br />Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />A single family home is a permitted use in the RR-IB zoning district. <br />The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining property. <br />The destruction of the residence by fire creates special conditions for this zoning lot. The <br />wetland, access from Shoreline Drive, and topography impact the rebuilding of this site. <br />The conditions do not apply generally to other land or structures in the district <br />in which said land is located.1 <br />All the zoning lots in the RR-IB district are subject to the same lot area, lot width, and <br />setback requirements. This lot is approximately 1/4 the required lot size for this district. <br />Therefore, the setback requirements are difficult to meet on a smaller parcel. The proposed <br />residence is an improvement from the existing structure in terms of the front and side <br />setback. <br />8. <br />9. <br />The gianting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />Variances are needed to rebuild a residence on this property. <br />The granting of the proposed variance will not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary^ to the intent of the Zoning Code. <br />The variance will not impair health, safety, comfort or morals. <br />#2362 Robert Howard <br />1300 Shoreline Drive <br />April 20, 199S <br />page--4 I
