Howard <br />1300 Shoreline Drive <br />Variances-Public Hearing <br />Zoning District: One Family Rural Residential District (2 acres) <br />Lot Area:150 ’ by 129.5=19,425 sq. ft. (.446 acres) <br />Application:The applicant is requesting variances to rebuild a residence on a lot where the <br />existing residence has been damaged by fire. Variances are needed for the <br />front, side, and rear setbacks, lot width, and lot area. <br />Pertinent Ordinances: <br />Section 10.28., RR-IB, One Family Rural Residential District <br />Section 10.03, General Provisions, Subd. 4, D. <br />Whenever a lawful non-conforming structure shall have been damaged by fire, flood, explosion, <br />earthquake, war, riot, or act of God, it may be reconstructed and used as before if it be <br />reconstructed within twelve (12) months after such calamity, unless the damage to the building or <br />structure is 75% or more of its fair market value as shown on the assessment records at the time of <br />damage, in which case the whole thereof shall be demolished, and any construction thereafter shall <br />be for a use in accordance with the provisions of this Zoning Chapter. <br />#2362 Robett Howard <br />1300 Shoreline Drive <br />April 20. 1998 <br />page—!
