This is a special situation because the former garage did not meet the side yard setback <br />requirements. The fire destroyed the garage and the applicant is required <br />to make the new garage meet setback requirements. Given triangular lot, the lot area, <br />required setback and standard 2-car garage size, it is not possible to locate a new garage <br />in an area that conforms to setbacks. <br />5.The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />The zoning setbacks apply to all other properties in this zoning district, however, most <br />lots are not triangular. <br />6.The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />A variance is needed to construct a new garage. It is not possible to locate a garage <br />on the property that doesn't increase hardcover and use the backyard. <br />7.The granting of the proposed variance will not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary to the intent of the Zoning Code. <br />The variance will not impair health, safety, comfort or morals. <br />8.The granting of such variance w ill not merely serve as a convenience to the applicant, <br />but is necessary' to alleviate demonstrable hardship or difficulty. <br />This property does have a demonstrable hardship given the zoning district setbacks and <br />the triangular shape of the lot. The location of the residence relative to the side property <br />lines limits the replacement of the garage on the site. <br />ISSUES <br />1. The subject property does not meet lot area, lot width or "■-..••t yard setback requirements. <br />2.The previous garage was destroyed by fire and variances are required to replace it <br />in the previous location. The applicant proposes to move it forward appro.ximately 5'-7'. <br />3. Hardcover will be reauced on site, however, it will exceed the 30% limit, as proposed. <br />4.The shape of the lot and the location of the existing residence and driveway limits <br />the allowed building pad for a new garage. <br />U2358 Randy and Starie Staffanson <br />1422 Park Drive <br />4/20/98 <br />page-4
