The amount of hardcover in <br />the 75’ to 250’ setback is not an issue with this application. Before the deck reconstruction, 15.6% <br />hardcover existed in the 0’ to 75’ lakeshore setback. The removal of a concrete patio located mostly <br />within this zone accounts for most of the decrease. For unknown reasons, the amount of hardcover <br />in the 75' to 250’ increased from 50.6% to 50.8% since 1992 when a variance to build a garage was <br />granted. There has been a net decrease of hardcover on the property, however. <br />STATEMENT OF HARDSHIP <br />Refer to the applicants statement of hardship (Attachment H). <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The deck is a replacement of a previous one of similar size. <br />2.The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The residence and original deck were built prior to current zoning requirements. <br />3.
