6. <br />7. <br />8. <br />9. <br />12. <br />The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining property. <br />The subject property is similar in size to other properties in the area. The location of the <br />house close to the property line is unique. <br />The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />All properties in this zoning district are subject to the side yard requirements. <br />The granting of the application is necessary for the preservation and enjoyment <br />of a substantial property right of the applicant. <br />The applicants will need to provide the Planning Commission with testimony regarding <br />their ability to enjoy the current residence as constructed compared to their need for <br />a second floor addition. <br />The granting of the proposed variance will not in any way impair health, safety, <br />comfort, morals, or in any other respect be contrary to the intent of the Zoning Code. <br />The variance will not impair health, safety, comfort or morals. <br />The granting of such variance will not merely serve as a convenience to the applicant, <br />but is necessary to alleviate demonstrable hardship or difficulty. <br />The applicants cannot add any more space to their current residence because of hardcover <br />and structural coverage requirements. The applicants have two options to have a larger <br />house on this site. The first is to seek a side yard variance to add another floor. The second <br />option is to remove the existing structure and build another house with a footprint of 1,500 <br />sq. ft. or less. <br />Construction of a new residence on this lot would be restricted if the garage remmns because <br />the garage is 939.9 sq. ft. and the allowed structural coverage is 2,532 sq. ft.
