The current property can continue to be used as a residence without any further variances. <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The plight of the landowner is created by a design. No further additions can occur <br />to this residence without changes to existing hardcover amounts. Any future additions <br />would need to rearrange existing hardcover to "bridge" the gap between the southern <br />end of the residence an the 250'-500' setback area. <br />3. The variance, if granted, will not alter the essential character of the locality. <br />The variance would reduce an existing 43’ side yard to 10'. The lakeshore view of the <br />proposed structure would be approximately 123' of 3 levels of structure, 44’ from lakeside <br />grade to the peak of the roof <br />4. Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />5. The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />Residences are allowed uses in the LR-IB district. Guest apartments are conditional <br />uses. A guest house would not be allowed because the property does not have the required <br />lot area. <br />6. The special conditions applying to the structure of land in question are peculiar <br />to such property or immediately adjoining property. The conditions do not apply generally <br />to other land or structures in the district in which said land is located. <br />There are no special conditions that apply to this property. It currently meets all <br />zoning requirements except that it exceeds hardcover in the 75 *250' setback. <br />8.
