(.51 acres) <br />Background:This applicant has been tabled or postponed several times. The applicant <br />has requested that this item be placed back on the January 20th agenda. <br />NOTE:A large packet was delivered to you in December regarding this item. Please <br />bring it to the January 20th meeting. If you need another copy, please <br />contact staff before the meeting. <br />Application:The application is for a conditional use permit to grade within 5' of the <br />south property line to allow the driveway and retaining wall to extend into the <br />side yard to provide more space to get in and out of the garage. <br />ANALYSIS <br />A conditional use permit is used to authorize and regulate a specific use in a specific district as <br />indicated by the Zoning Code. Grading within 5' of the property line in a residential district is a <br />conditional use.
