This application is regarding a front yard setback variance for a 350 square foot garage <br />addition. <br /> <br />2. MN§15.99 Application Deadline. The application was received on May 16, 2023 and considered <br />to be complete on May 17. Therefore the 60-Day review period expires on July 16, 2023. <br /> <br />3. Background/ Summary. The applicants’ property is a corner lot, situated on Brown Road South and <br />Fox Ridge Road. The existing home is set back 56.9 feet from the front lot line (Brown Road South). The <br />applicants have proposed a 14’ x 25’ garage addition on the Brown Road side. A small portion of the <br />addition will require a front yard setback variance to allow a setback 46 feet from the front property line <br />where a 50-foot setback is required. <br /> <br />4. Variance Description. The garage addition is proposed in a location which will be accessible to the <br />existing driveway and garage. The existing home is angled on the property toward the corner of Brown <br />Road and Fox Ridge Road; a wetland in the southeast corner of the property and the septic system area <br />limit locations to construct a functional garage addition. There is mature screening along Brown Road. <br />The driveway and home’s orientation to the neighborhood road (Fox Ridge Road) results in Fox Ridge <br />Road being perceived as the front. <br /> <br />5. Planning Commission Vote and Comment. On June 20th the Planning Commission held a public <br />hearing. Following the public hearing, the Planning Commission discussed the practical difficulties <br />resulting from the location of the wetland and septic infrastructure on a corner lot and voted 5 to 0 on a <br />motion to approve the requested variance. <br /> <br />6. Public Comment. Neighbor acknowledgements were submitted, however no comments from the <br />public were received. <br /> <br />7. Staff Recommendation.
