Purpose. This application is regarding a house addition that requires variances from average <br />lakeshore setback, 75-foot lake setback, hardcover, hardcover within the 75-foot setback and side <br />yard setback. <br /> <br />2. MN§15.99 Application Deadline. The application was received on December 2, 2022 and <br />considered to be complete on May 31, 2023. The 60-Day review period expires on July 30, 2023. <br /> <br />3. Background/ Summary. The <br />subject property is a substandard lot <br />in the LR-1B Zoning District (1- <br />Acre). The existing one-story home <br />is nonconforming to the required <br />setbacks and is over on hardcover. <br />The applicant is requesting variances <br />from average lakeshore setback, 75- <br />foot lake setback, hardcover beyond <br />the 25%, hardcover within the 75- <br />foot lake setback and side yard <br />setback to build an addition. The <br />proposed house addition is located <br />on the north side of the home and <br />maintains the existing lakeyard <br />setback of 35 feet. However, the <br />home design proposes a 25’ wide <br />door on the lakeside of the home <br />requiring a new stoop/steps. The new <br />stoop and steps create a new <br />lakeyard encroachment closer to the <br />lake at 26 feet to the OHWL. The <br />home addition is two stories with a <br />rooftop terrace above the second <br />story which creates a new vertical <br />encroachment into the 75-foot and average lakeshore setback. The existing home is a one-story <br />building and the proposed addition is approximately 12 feet taller in height. The proposed project <br />slightly reduces the overall hardcover, but is still over the maximum of 25%. <br /> <br />4. Planning Commission Vote and Comment. On June 20, 2023, the Planning Commission held a <br />public hearing, no public comments were made. The Commission reviewed the application and <br />discussed the practical difficulties. The Commission did not reach a consensus voting to approve the <br />application by a vote of 3 to 2. The Planning Commission was concerned with the overall height of <br />the addition and that it significantly expanded the nonconformity. The Commission was also <br />concerned with practical difficulties not being met. The Planning Commission was supportive of the <br />reduction in hardcover and noted the substandard irregular lot shape and existing conditions as
