At such time that a permit for expansion of the existing home on Lot 5 is issued; <br />e. At such time that the existing system is found to be non-compliant and ordered to <br />be replaced; <br />2. Regardless whether any of the above has occurred, the easement shall expire and the system <br />shall be removed no later than 2 (two) years after the date of filing of the plat with Hennepin <br />County. <br />The above has been written into the conditions of the Resolution. <br /> <br />Road Agreement. Mr. MacKinnon has granted the required access easement for Outlot D, and it <br />has been recorded with Hennepin County. It is staffs’ understanding that the applicant and the <br />Kintyre HOA are close to finalizing a cost share agreement regarding maintenance of Kintyre <br />Lane. <br /> <br />Staff Recommendation <br />Staff has prepared a resolution for preliminary plat approval incorporating general and specific <br />conditions of approval for Council consideration. <br /> <br />COUNCIL ACTION REQUESTED <br />Review the attached materials and resolution. If all issues of concern have been suitably addressed, <br />move to adopt or amend the attached resolution entitled A Resolution Granting Preliminary Plat <br />Approval for a Class III Subdivision of Property Located at 200-350 Stubbs Bay Road North <br />- File No. 15-3763. <br /> <br /> <br />
