FILE # LA23-000005 <br />July 17, 2023 <br />Page 4 of 4 <br />Public Comments <br />To date, no public comments have been received. <br />Planning Staff Recommendation <br />Staff recommends approval of the conditional use permit for construction of the proposed permanent <br />dock subject to the following conditions: <br />1. The seawall may be allowed as long as it continues to be permitted by the other regulatory <br />agencies, including but not limited to MCWD, LMCD, and DNR and is in conformity with the <br />rules and regulations of those agencies; and <br />2. A buildingpermit is required for the installation of the seawall. <br />3. An encroachment agreement is executed for the use of Lydiard Beach during the construction <br />of the seawall subject to the following conditions: <br />a. The construction of the seawall and the subsequent use of Lydiard Beach shall be <br />completed in no more than 30 days after the work begins. <br />b. The applicant must restore any damaged landscaping, fencing, gravel drive within one <br />(1) calendar year of the project's completion. <br />c. The storage of equipment or construction may not impact snow removal or storage <br />of snow on City owned property. <br />d.
