<br />15-3739 300 Sixth Ave N <br />July 9, 2015 <br />Page 4 <br /> <br />Recent Submittals <br />The applicant’s recent submittals include the revised plans depicting Plan A with road options A <br />and B, and Plan B with road options A and B. Also included are color depictions of the proposed <br />covenant restrictions, and an analysis of the tree impacts for the two Plan B road options. A <br />revised and updated Conservation Design Report is attached as Exhibit H. <br /> <br />Conservation Design <br />The updated Conservation Design Report is based on the Plan B lot layout. Council is requested <br />to review pages 1-5 of this report to gain an overview of the natural resources on the site and <br />how they are proposed to be preserved, impacted, or managed. The draft Covenants and <br />associated descriptions and exhibits have been included in the Conservation Design Report. <br /> <br />City Engineer Comments <br />The City Engineer has now reviewed the information submitted in June and July; his comments <br />are attached as Exhibit C. Staff will provide an overview of those comments at the meeting. <br /> <br />Park Commission Review <br />The Park Commission reviewed this subdivision at its July 6 meeting and concluded that because <br />the property abuts County Road 6 and a proposed trail along CR6 is indicated in the CMP <br />Comprehensive Trail Plan, it would be appropriate that a 10’ easement for trail purposes be <br />requested along the south boundary of the property, as well as Park Dedication Fee required for <br />10 new lots. <br />It should be noted that nearly all property abutting County Road 6 will be within one of the two <br />Outlots that are not being developed. Applicant should be asked whether he is in the position to <br />grant the trail easement at this time; it may have to wait until such time that those Outlots are <br />further developed, if ever. <br /> <br />Public Comments <br />Exhibit I contains written and emailed public comments received throughout the review process. <br /> <br />Issues for Consideration <br />The preliminary plat application has been reviewed by the Planning Commission and is <br />forwarded to the Council for review. Staff would suggest the following questions or issues be <br />considered by the Council: <br />1. Revisions to the original plan resulting in Plan B were viewed by the Planning Commission <br />as an improvement to the subdivision which will lead to reduced impact to the Big Woods <br />area. Absent any City codes that specifically protect the Big Woods from development, and <br />noting that the property owner’s greatest desire is to preserve the established prairie area, <br />does the current plan layout provide an acceptable compromise between the desires of the <br />applicant and property owner, and the desires of some members of the public? <br />2. Similarly, do the proposed covenant limitations on tree removal within the Big Woods lots <br />adequate preservation measures? Does the Conservation Design Report provide sufficient <br />justification to support the impacts to the Big Woods?
