MINUTES OF THE <br />ORONO CITY COUNCIL MEETING <br />Monday, August 10, 2015 <br />7:00 o'clock pm. <br />11. #15-3760 CITY OF ORONO, AMEND CITY CODE TO ALLOW CLINICS IN B-1, B-3 <br />ZONING (continued) <br />clinics. In response to a desire to allow clinics in more service and retail based zoning districts, the draft <br />ordinance defines "clinics for human care on an outpatient basis only" and allows them by conditional use <br />in the B-1 zoning district and by permitted use in the B-3 zoning district. <br />Levang stated on Page 2 under Item 1(e) they are showing their age by talking about record shops. <br />Levang stated she has no alternative word to suggest, however. <br />Cornick noted there is a record shop in Mound. <br />Walsh stated he did have one person contact him regarding this item asking whether Planned Parenthood <br />would be considered a clinic and allowed under this amendment. <br />Barnhart stated if they have doctors at the clinic or medically licensed, then they would be considered a <br />clinic. Barnhart noted the definition is a place where a group of licensed medical practitioners provide <br />medical treatment or advice on an outpatient only basis. Barnhart indicated he is not too familiar with <br />what Planned Parenthood offers for services, but if they are medical providers, they would be part of that. <br />Printup asked if the City already allows clinics in the City. <br />Barnhart stated they are allowed in various forms in the B-4 District. <br />Printup noted this would be nothing new for that district then. <br />Cornick asked if Staff is assuming that human care does not include tattoos. <br />Barnhart stated he would not classify that as a clinic unless they met the definition included in the <br />ordinance. <br />McMillan asked if the City has anyone who is interested in starting a hair replacement business. <br />Barnhart indicated they do not. <br />McMillan noted they do have an office and professional area currently and that this would be expanding <br />clinics to other parts of the City. McMillan asked if it would mostly be in Navarre. <br />Barnhart indicated it would be. <br />Levang moved, Cornick seconded, to adopt ORDINANCE NO., THIRD SERIES, an Ordinance <br />Amending the Orono Municipal Code by Amending Section 78-643 and 78-704 Regarding Adding <br />Clinics in the B-1 and B-3 Zoning Districts. VOTE: Ayes 4, Nays 1, Walsh Opposed. <br />12. #15-3766 CITY OF ORONO, AMEND CITY CODE RELATING TO AVERAGE <br />LAKESHORE SETBACK <br />Barnhart stated this ordinance codifies the application of average setback where a subject lot is adjacent to <br />a vacant lot or right-of-way. The draft ordinance also removes the provision that Staff can approve a <br />project where the average lakeshore setback cannot be met. <br />Page 26 of 32 <br />
