Olson, City Planner <br />March 9, 1933 <br />SUBJECT: Molly's Corner Status Report <br />Mr. Berg has submitted the attached letter offering William and Stanley Gregory's <br />proposed solution to the Molly's Corner situation. This is a positive approach <br />in meeting the needs of the Gregory's and Duffs, the neighbors and the general <br />public. <br />This item is on the Council agenda for 3-14-83 as a status report only, to keep <br />the Council informed of discussions. Mr. Berg indicated that neither he nor the <br />Gregory's would attend this meeting although both will have received notice of it. <br />The public hearing will continue at 3:00 P.M. Monday March 21, 1983 before the <br />Planning Commission where they will consider recommendations regarding the road <br />vacation application. The staff recommendation to Che Planning Commission will <br />be along the lines of Mr. Berg's proposal. Referring to the items in his letter <br />by number: <br />The City should accept deeds to blk 18 (in the parking area) and <br />to any interest Gregory's may have in Brackett Avenue to clarify <br />title and responsibility. The City should erect fencing along <br />Gregory's property line and the railroad track. John Gerhardson's <br />attached memo indicates cost estimates. Gating, regulation of hours <br />and routine maintenance would be City duties. <br />The only issue might be parking lot size. There is ^ need to Increase <br />it. But the City Instead of Gregory should obtain an easement from <br />Burlington Northern to maintain that part of the parking now on railroad <br />right of way and install the fence accordingly. Also, Gregory's have a <br />wire fence which now runs through the woods apparently on the westerly <br />(straight line) edge of Bracketts Avenue. The new fencing should also <br />follow this line not the edge of the gravelled area. This part of <br />Bracketts Avenue should not be vacated. <br />The contract for deed idea for the shoreline areas may make sense, <br />especially in assuring Gregory's and the neighbors that the City <br />really will maintain the area. However, in agreeing to such a <br />contract, the City should not give up any rights we claim to the <br />road right of way should a disagreement arise over maintenance <br />quality. <br />Staff will recommend vacation of that part of Bracketts Avenue that <br />forms a triangular indentation on the Gregory property west of County <br />Road 15. <br />The west side of County Road 15 is now and has for some time been <br />posted no parking the entire way from 400 ft. east of Orono Orchard <br />Road through this whole area and on westward from Tanaser Lake bridge. <br />One or two additional signs might be added if enforcement should become <br />a problem, but I don't believe it has been. <br />.
