The shoreline along Brown's Bay being conveyed <br />to the City of Orono pursuant to Paragraph 2 above <br />could not be used as a boat launching site and must <br />be held by the City of Orono, (i.e*, it may not be <br />transferred to any other governmental agency without <br />the express written permission of the Gregory's and <br />adjoining landowners. <br />6. Orono would agree that the Gregory's would be <br />entitled to maintain a multiple dock on Tanager Lake <br />serving any lots created from their property in <br />fut^e subdivisions of their land. The Gregory's, <br />their heirs, successors and assigns would be en­ <br />titled to maintain one boat slip on Tanager Lake <br />for the use and benefit of each lot created from <br />the Gregory land in the future. It is estimated <br />that there will eventually be 3 lots created from <br />the present Gregory property; it is conceivable <br />that future modifications to Orono's Code of Or­ <br />dinances would permit additional lots. Orono would <br />agree to permit the granting of easements for access <br />to Tanager Lake for the benefit of those lots carved <br />from the Gregory land not having direct access to <br />Tanager Lake. The Gregory's would be entitled to <br />allocate boat slips between the Tanager Bay multiple <br />dock, and any dock created or maintained on the land <br />conveyed to Orono in Paragraph 2 above. The buoy <br />rights discussed in said Paragraph 2 are to be <br />considered in addition to said dock rights inasmuch <br />is foreseeable that individuals may maintain <br />small water craft on Tanager Lake which they would <br />use for access to boat buoys on Brown's Bay. (Sail­ <br />boats are unable to travel beneath the County Road <br />15 highway bridge over the channel leading to Tanager Lake*) <br />7, Orono and Hennepin County must consent to the <br />Torrens action brought by the Gregory's. The action <br />would be modified to conform to the new boundaries <br />established through the proposed agreement. <br />8.
