During the review of the Raster application <br />eary this summer, the Council considered the many conflicts in the <br />reports presented by the various reviewing agencies and the <br />traditional position of the City regarding the alteration of <br />designated wetlands. Council decided there was no need to change the <br />ordinance but merely to set up criteria for such reviews and that if <br />specific findings could be made, the alteration of the wetland would be <br />considered. <br />Review Criteria <br />1.Disposal of soils: Soils excavated from wetland could <br />not be used to grade and fill banks of pond but had to be <br />placed a minimum of 50 feet away from pond/wetland basin <br />and hay bales staked around the spoils area. <br />2.Time of year alteration is performed: Suction <br />dredging remains the best method but not always <br />feasible. Early winter is the best time to dredge <br />wetlands. In this application given the type of soils <br />make up, early winter may be a must. <br />3.Location of dredged area within wetlands: <br />Vegetation must not be disturbed between pond and <br />outlet from wetland. Vegetation must remain to catch <br />or filter sediment and slow down rate of flow. In this <br />case, the grassy area at the 1032 elevation leading to <br />culvert will serve as buffer—Conservation and Flowage <br />easement should be amended to include newly defined <br />protected area. <br />4.Replacement Factor - If the reviewing staff confirms <br />reduction in assimilative capacity of wetland created <br />by alteration than a matching area must be set aside to <br />replace assimilative capacity. The extension of the <br />protected wetland area south to the culvert providing <br />additional grassy, permeable surface will provide <br />replacement but adequacy of that replacement should be <br />confirmed by hydraulic information. <br />Staff Recommendation <br />To approve the partial alteration of the designated wetlands on Lot 2, <br />Willow Run based on the following findings: <br />1. The wetlands functions as a localized, seasonal <br />collection basin and is not part of a major wetlands <br />system. <br />2. Wetland is located in the outer edges of the watershed <br />leading to Lake Minnetonka. <br />3.
